These are the terms for the Prop65Shield private beta. Checking the box on the invite page means you agree to them.

What Prop65Shield is

Prop65Shield organizes public California Proposition 65 enforcement records, including 60-day notices, settlements, and related filings from the California Attorney General's office and the Office of Environmental Health Hazard Assessment, into searchable profiles and assessments.

Not legal advice

Prop65Shield is a research tool, not a law firm. Nothing in it is legal advice, and using it doesn't create an attorney-client relationship with us, even though many of our beta users are attorneys. Talk to your own counsel before acting on anything you see here.

This is a beta

The product is new and still being built. Some of what you see is drawn from a limited, labeled set of cases rather than the full historical record. Public records can contain errors, and so can our processing of them. Verify anything that matters against the original source before you rely on it.

Your access

Access is by invitation only. Don't share your invite link or account access with anyone else. Don't submit privileged, client-confidential, or other sensitive material. Prop65Shield is not a law firm, using it doesn't create an attorney-client relationship, and we don't promise a submission will remain privileged — anything you enter is logged and is not treated as confidential. Don't use Prop65Shield to decide whether to extend someone credit, a job, insurance, or housing; that isn't what it's for. You may not scrape, bulk-export, or redistribute what you see.

No cost, no uptime promise

The beta is free. We're not promising any particular uptime, support response time, or that a feature you use today will still be there tomorrow. We may change or end the beta, or any part of it, without notice.

No warranties

The beta is provided as is and as available, with no warranty of any kind. To the fullest extent the law allows, we disclaim all warranties, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from course of dealing or trade usage. We do not warrant that the beta will be accurate, complete, current, uninterrupted, secure, or free of errors. Some jurisdictions don't allow certain warranty exclusions, so parts of this section may not apply to you.

Limit on our liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, lost revenue, lost business, lost data, or professional or reputational harm, arising out of or relating to the beta. This applies whether the claim is brought in contract, tort, negligence, strict liability, or on any other basis, and it applies even if we were told such damages were possible.

Our total liability for all claims relating to the beta is capped at one hundred U.S. dollars. The beta is provided at no charge, and that cap is a material part of the consideration for providing it. Nothing here limits liability that cannot be limited under California law, including liability for fraud or for our own gross negligence or willful misconduct. Some jurisdictions don't allow certain liability limits, so parts of this section may not apply to you.

Your responsibility for how you use it

You are responsible for your own professional judgment. Prop65Shield is one input, not a substitute for reading the underlying record, doing your own diligence, or advising your own clients. If someone brings a claim against us because of how you used the beta, or because you broke these terms, you agree to cover our reasonable costs of defending it.

Governing law

These terms are governed by California law. Any dispute goes to state or federal court in California.

Who you're agreeing with, changes, and contact

These terms are an agreement between you and Ian Malone, an individual doing business as Prop65Shield, who operates Prop65Shield. Prop65Shield is independent and is not affiliated with, endorsed by, or acting on behalf of the California Attorney General's office, the Office of Environmental Health Hazard Assessment, or any other government body. We may update these terms; the version posted here is the current one. Questions may be sent to team@prop65shield.com.
